Terms of Participation – NHS SUMMERCAR Giveaway 2026

including General Terms and Conditions for Shop Purchases

This English translation is provided for convenience only. In the event of any discrepancy or dispute, the German version of these Terms of Participation shall prevail.

Organizer: Winter Automotive GmbH, Hausstattfeld 9b, 6370 Kitzbühel, Austria, hereinafter referred to as the "Organizer".

These Terms of Participation govern the conduct of the "NHS SUMMERCAR Giveaway 2026", hereinafter referred to as the "Giveaway". By performing any act of participation, the participant accepts these Terms of Participation. The Organizer's General Terms and Conditions are integrated as a separate section under § 9 and apply where participation takes place via a purchase in the online shop. The means of participation without purchase are set out in § 8.

§ 1 Scope and Organizer

  1. The Organizer and controller within the meaning of the General Data Protection Regulation is:

  2. The Giveaway takes place within the scope of the NHS SUMMERCAR brand. Promotion, technical processing and purchase-based participation may take place, among other channels, via websites and online shops of the Organizer, in particular via schaefchen.at and other sites operated or used by the Organizer.
  3. The technical and organizational administration of the Giveaway, in particular the ticket system, the reconciliation with orders and the digitization of postal entries, is carried out in cooperation with German eTrade GmbH, Antonstraße 3c, 01097 Dresden, Germany, acting as a processor on behalf of the Organizer.
  4. These Terms of Participation govern in particular eligibility, means of participation, purchase-based participation, social media participation, postal participation, ticket allocation, winner determination, prize handover, data protection, liability, and the General Terms and Conditions applicable to shop purchases.

§ 2 Promotion Period

  1. The Giveaway runs from 12 June 2026, 00:00 CEST, until 12 August 2026, 23:59:59 CEST.
  2. The decisive point in time for participation, depending on the means of participation, is:
    1. for purchase-based participation pursuant to § 4, the time of the payment confirmation recorded by the system,
    2. for postal participation pursuant to § 8.2, the physical receipt by the recipient named therein; the postmark alone is not sufficient,
    3. for social media participation pursuant to § 8.1, the time of publication of the public post within the Giveaway period.
  3. Late, incomplete or not clearly attributable entries will not be considered.
  4. The Organizer may interrupt, adjust or extend the period for good cause if this is necessary due to technical disruptions, attempted abuse, force majeure, official orders or other circumstances that materially impair the proper conduct of the Giveaway. This must not result in any unreasonable disadvantage to participants. Information in this regard will be provided via the Organizer's website.

§ 3 Eligibility and Exclusion

  1. Eligible to participate are natural persons who are at least 18 years of age at the time of participation and have their permanent residence in Austria or Germany.
  2. An extension to further countries is only permissible if the legal requirements of the respective country have been reviewed in advance.
  3. Participation is only possible in person. Participation under a false name, under a pseudonym, via automated services, bots, sweepstakes clubs, multiple accounts, third-party accounts or on behalf of third parties is excluded.
  4. Employees of the Organizer, commissioned service providers, persons involved in conducting the Giveaway, as well as relatives of the first and second degree and persons living in the same household are excluded from participation.
  5. Any act of participation pursuant to § 4 or § 8 constitutes acceptance of these Terms of Participation.
  6. The Organizer is entitled to exclude participants if there are reasonable grounds to suspect manipulation, abuse, multiple participation under different identities, false statements or other violations of these Terms of Participation.

§ 4 Participation via Purchase in the Online Shop

  1. Every order placed and paid for via an online shop operated by the Organizer during the Giveaway period automatically participates in the Giveaway, provided the purchaser is eligible and no ground for exclusion exists.
  2. One digital ticket is allocated for every full 10.00 euros of paid gross merchandise value. The decisive amount is the gross merchandise value of the products after deduction of discounts, vouchers and other price reductions. Shipping costs, transaction costs, service fees and other ancillary charges are not taken into account.
  3. Example: A paid gross merchandise value of 49.90 euros results in four tickets. A remaining amount below 10.00 euros is not rounded up.
  4. Tickets from purchases are initially provisional. They only become finally valid if the purchase contract has been validly concluded, the order has been paid in full and has not been withdrawn from, reversed, cancelled, fully refunded or blocked due to abuse.
  5. In the event of a partial return, partial withdrawal, partial refund or subsequent price reduction, the number of tickets will be recalculated on the basis of the gross merchandise value finally retained and paid.
  6. In the event of a complete withdrawal, complete return, complete refund, chargeback, suspected fraud or other reversal of the transaction, the allocated tickets lapse retroactively.
  7. Statutory rights of withdrawal remain fully unaffected. Participants must not be disadvantaged for exercising statutory consumer rights. If a winner is drawn via a ticket that becomes invalid before the prize is handed over, the claim to the prize lapses and a replacement winner will be determined pursuant to § 5.
  8. To ensure equal chances, an upper limit of 50 tickets in total per person applies regardless of the means of participation. This covers purchase-based participation and the means of participation without purchase pursuant to § 8 combined. Once this limit is reached, no further tickets will be credited.
  9. A purchase is not required for participation and does not increase the chance of winning beyond the ticket allocation set out in these Terms of Participation. The free means of participation are set out in § 8 and are given equal consideration.
  10. Product prices are not increased as a result of the Giveaway. The purchase price is consideration for the goods purchased, not for participation in the Giveaway.

§ 5 Prize, Draw and Processing

  1. One specific used vehicle will be raffled among all valid tickets:
    BMW M3 E92 with modifications
    estimated total value including installed components: approx. 30,000 euros gross
  2. The vehicle is raffled as a specifically determined prize in kind. It is precisely the vehicle described under § 5 para. 1. There is no entitlement to a different vehicle, a replacement model, a cash payout of the value, a partial payout, an exchange or any other form of compensation.
  3. The Organizer maintains complete vehicle documentation. This will be handed over to the winner at the latest upon handover of the vehicle and may be requested by participants prior to participation by email to support@nohalfsends.shop. The vehicle documentation contains the following information:
    1. vehicle identification number (fully documented internally),
    2. make, model, year of manufacture, first registration, where available,
    3. mileage at the start of the Giveaway,
    4. engine and key technical data,
    5. list of known modifications,
    6. known defects and previous damage,
    7. available vehicle papers and documents,
    8. photos and condition description,
    9. confirmation that the vehicle will be handed over free of third-party rights.
  4. Important notice regarding condition and registration:
    1. The vehicle is expressly raffled as a used vehicle, project vehicle and tuning object.
    2. The vehicle will be handed over in the condition described in these Terms of Participation, the vehicle documentation pursuant to para. 3 and the images provided.
    3. In its current condition, the vehicle does not have a valid road registration or operating permit for Austria, Germany or the European Union.
    4. In its current condition, the vehicle is not approved for use on public roads.
    5. The winner is informed that the vehicle cannot be used directly on public roads.
    6. A possible subsequent individual approval, type approval, registration, inspection or licensing is not guaranteed.
    7. All measures, costs, risks, inspections, expert reports, transports and administrative procedures in connection with a possible subsequent registration are borne exclusively by the winner.
    8. As long as no lawful registration exists, the vehicle may only be transported in a permissible manner, in particular by trailer, car transporter or freight forwarder.
  5. The Organizer is not liable for the vehicle being capable of registration, approval, insurance or use on public roads in the winner's country of residence, unless mandatory statutory provisions provide otherwise.
  6. The Organizer warrants that, to the best of its knowledge, the prize will be handed over free of third-party rights. Should encumbrances, third-party ownership rights or other legal impediments exist, these will be disclosed before the start of the Giveaway or removed before handover.
  7. The vehicle is handed over as a prize free of charge. No warranty or guarantee is assumed for the technical condition, functionality, roadworthiness or specific characteristics of the vehicle, to the extent legally permissible. The condition owed is determined exclusively by these Terms of Participation and the vehicle documentation pursuant to para. 3. Liability for fraudulently concealed defects and liability pursuant to § 7 remain unaffected.
  8. If the specifically advertised vehicle is no longer available before handover for reasons not attributable to the Organizer, for example due to theft, fire, accident or force majeure, the Organizer may offer an equivalent replacement prize of comparable market value. If this is objectively impossible or legally unreasonable, the Giveaway may be cancelled subject to mandatory statutory rights. Mandatory consumer rights that have already arisen remain unaffected.
  9. The draw will not be public and will take place no earlier than 13 August 2026 and no later than 30 September 2026. The winner will be determined by a certified random procedure via the external service provider ViralSweep, LLC. The draw process will be documented.
  10. The winner will be notified by email to the email address provided during participation or associated with the order.
  11. The winner must respond within 14 calendar days from dispatch of the winner notification and provide proof of identity, of being at least 18 years of age, and of residence.
  12. If the winner does not respond in time, cannot provide the required proof, is not eligible to participate, or if the drawn ticket becomes invalid, the claim to the prize lapses. In this case, a replacement winner will be drawn from all remaining valid tickets.
  13. The personal handover of the vehicle takes place at the Organizer's registered office in Kitzbühel, Austria, or at a handover location determined by the Organizer. A different handover is only possible by prior written agreement.
  14. All additional costs are borne by the winner. These include in particular:
    1. travel to and from the collection,
    2. transport costs, in particular trailer, car transporter, freight forwarder or vehicle transfer,
    3. transport insurance,
    4. costs for expert reports, technical inspections, individual approval, type approval, registration, licensing or customs,
    5. running costs upon later commissioning, in particular insurance, taxes, fuel, maintenance and repairs,
    6. any taxes, levies or fees in the winner's country of residence.
  15. If a gambling levy or comparable statutory levy is payable for the Giveaway in Austria, this will be borne by the Organizer, unless otherwise required by law. The winner's tax obligations in their country of residence remain unaffected.
  16. Any publication of the winner, for example with first name, initial of the surname, place of residence, photo, video or handover material, will only take place with separate voluntary consent. This consent may be revoked at any time with effect for the future.

§ 6 Data Protection in Connection with the Giveaway

  1. The controller for the processing of personal data is Winter Automotive GmbH, Hausstattfeld 9b, 6370 Kitzbühel, Austria.
  2. Personal data is processed for the purpose of conducting the Giveaway, verifying eligibility, allocating tickets, determining the winner, notifying the winner, handing over the prize, preventing abuse, complying with legal obligations and, where separately consented to, for marketing purposes.
  3. The legal bases are:
    1. Art. 6(1)(b) GDPR for conducting and processing the Giveaway,
    2. Art. 6(1)(c) GDPR for legal obligations,
    3. Art. 6(1)(f) GDPR for IT security, fraud prevention, legal defense and proper documentation,
    4. Art. 6(1)(a) GDPR for marketing, newsletters and voluntary publication of the winner.
  4. Data processed may include in particular:
    1. name,
    2. address,
    3. email address,
    4. date of birth,
    5. order data and payment status for purchase-based participation,
    6. number of tickets and ticket status,
    7. social media profile name, profile URL, post URL, hashtag and publicly visible content for social media participation,
    8. receipt data of postal entries,
    9. verification data to confirm the winner's age, identity and residence.
  5. Recipients or processors may include in particular:
    1. German eTrade GmbH, for the ticket system, order reconciliation and digitization of postal entries,
    2. ViralSweep, LLC, USA, for the technical execution of the random draw,
    3. IT hosting providers,
    4. email dispatch service providers,
    5. tax advisors, legal advisors, authorities or other bodies, where required by law.
  6. If personal data is transferred to ViralSweep, LLC in the USA or to another third country, this takes place on the basis of standard contractual clauses pursuant to Art. 46 GDPR, including a transfer impact assessment and, where necessary, additional safeguards, or, if the recipient holds a valid certification there, on the basis of the adequacy decision regarding the EU-US Data Privacy Framework.
  7. Agreements pursuant to Art. 28 GDPR are concluded with all processors, where required.
  8. Data of non-winning participants will be deleted no later than 90 days after the final conclusion of the Giveaway and successful handover of the prize, unless statutory retention obligations, documentation obligations or legitimate interests prevent this.
  9. Winner data may be stored for a longer period, in particular to fulfill tax, commercial and legal documentation obligations.
  10. Data subjects have, subject to the statutory requirements, rights of access, rectification, erasure, restriction of processing, data portability and objection pursuant to Art. 15 to 21 GDPR.
  11. Consents may be revoked at any time with effect for the future, for example by email to support@nohalfsends.shop or via an unsubscribe link.
  12. Data subjects have the right to lodge a complaint with a data protection supervisory authority. The Austrian Data Protection Authority may in particular be competent.
  13. No automated individual decision-making, including profiling, takes place.
  14. Data protection inquiries may be directed to: support@nohalfsends.shop.

§ 7 Exclusion, Manipulation and Liability

  1. The Organizer may exclude participants from the Giveaway if they violate these Terms of Participation or if there are reasonable grounds to suspect:
    1. false or incomplete statements,
    2. manipulation of the ticket system,
    3. use of bots, scripts, automated services or multiple accounts,
    4. participation on behalf of third parties,
    5. unlawful, insulting, discriminatory, violence-glorifying, pornographic, trademark-infringing, copyright-infringing or otherwise impermissible content,
    6. violations of platform rules,
    7. abuse of returns, payments, vouchers or orders.
  2. The Organizer does not guarantee the constant, uninterrupted and error-free availability of the website, online shop, ticket system, social media platforms, email services or other technical infrastructure.
  3. In cases of slight negligence, the Organizer is only liable for the breach of material contractual obligations and only limited to the foreseeable damage typical for the contract.
  4. Liability for damages arising from injury to life, body or health, for intent, gross negligence, fraudulent intent, assumed guarantees and mandatory statutory claims remains unaffected.
  5. Liability for the subsequent registration, approval, usability, roadworthiness or economic exploitability of the vehicle is excluded, to the extent legally permissible and to the extent that the respective circumstance has been disclosed in these Terms of Participation or the vehicle documentation.

§ 8 Participation Without Purchase

  1. Participation in the Giveaway is also possible without a purchase. No purchase is necessary to participate. Free entries are given equal consideration in the draw; every valid ticket has the same chance of winning.
  2. A uniform overall limit of 50 tickets in total per person applies to all means of participation. This limit covers purchase-based participation, social media participation and postal participation combined.

§ 8.1 Participation via Social Media

  1. Participants may create their own creative edits, so-called social media cuts, from NHS SUMMERCAR material officially released by the Organizer and post them publicly.
  2. Only material in which the Organizer holds the necessary rights or which the Organizer has expressly released for this Giveaway is permitted. Third-party music, third-party videos, third-party trademarks, third-party images of persons or other third-party content may only be used if the participant personally holds all necessary rights.
  3. The post must be publicly accessible during the Giveaway period and must clearly contain the hashtag #NHSSummercarGiveaway.
  4. The participant must submit the link to the post via the submission channel provided by the Organizer, for example via a form, by email or via another clearly indicated contact option. The specific submission channel will be indicated on the Giveaway page.
  5. After manual review, one ticket is allocated per valid post. A maximum of one social media post per person and calendar day will be considered.
  6. Social media tickets count towards the overall limit of 50 tickets per person.
  7. The post must remain publicly accessible at least until the winner determination is completed. If the post is deleted, hidden, blocked or set to private before then, the ticket may become invalid.
  8. Posts must not infringe any third-party rights, in particular no copyrights, trademark rights, personality rights, data protection rights or platform rules.
  9. Impermissible, off-topic, insulting, misleading, unlawful or otherwise inappropriate posts will be excluded.
  10. This promotion is in no way connected to Instagram, YouTube, TikTok or any other platforms and is neither sponsored, endorsed, administered nor organized by these platforms.
  11. Participants release Instagram, YouTube, TikTok and other affected platforms from any claims in connection with their participation, to the extent legally permissible.
  12. For posts on YouTube, the YouTube Terms of Service, the YouTube Community Guidelines and the YouTube contest policies additionally apply. Posts that violate these will be excluded.
  13. For posts on Instagram, the Instagram Terms of Use and Promotion Guidelines additionally apply. In particular, participants must not incorrectly tag persons and must not assert any inaccurate association with Instagram.
  14. The Organizer recommends additionally labeling posts as advertising or giveaway participation, for example with #Werbung, #Anzeige or #ad, since a chance of winning is associated with the post.
  15. The Organizer does not receive any automatic comprehensive transfer of rights to the post through participation. Any use of the post by the Organizer for its own advertising, reporting or reposting will only take place if the participant gives separate and voluntary consent. Such consent may be revoked at any time with effect for the future.

§ 8.2 Participation by Post

  1. Participation without purchase is also possible by sufficiently stamped letter. The postage is borne by the participant.

    1. first name and surname,
    2. full address with street, house number, postal code, city and country,
    3. valid email address,
    4. date of birth,
    5. the following declaration: "I am participating in the NHS SUMMERCAR Giveaway 2026 and accept the Terms of Participation." (German: „Ich nehme am NHS SUMMERCAR Giveaway 2026 teil und akzeptiere die Teilnahmebedingungen.“)
  4. One ticket is allocated per valid postal entry. A maximum of one postal entry per person and calendar day will be considered.
  5. Postal tickets count towards the overall limit of 50 tickets per person.
  6. The decisive factor is physical receipt no later than 12 August 2026. The postmark is not sufficient.
  7. Incomplete, illegible, late or not clearly attributable entries will not be considered.

§ 9 General Terms and Conditions for Shop Purchases

§ 9.1 Scope, Contracting Party and Applicable Law

  1. These General Terms and Conditions apply to all orders placed by consumers via the online shops operated by the Organizer.
  2. The contracting party is:

  3. Contracts are concluded exclusively with consumers.
  4. Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers with their habitual residence in another country, the mandatory consumer protection provisions of that country remain unaffected.
  5. Where applicable, the Austrian Consumer Protection Act (Konsumentenschutzgesetz) and the Austrian Distance and Off-Premises Transactions Act (Fern- und Auswärtsgeschäfte-Gesetz) apply in particular.

§ 9.2 Conclusion of Contract in Electronic Commerce

  1. The presentation of products in the online shop does not constitute a legally binding offer, but a non-binding invitation to place an order.
  2. By submitting the order, the customer makes a binding offer to conclude a purchase contract.
  3. An automatically sent order receipt confirmation merely confirms receipt of the order and does not yet constitute acceptance of the offer.
  4. The contract is concluded when the Organizer expressly accepts the order, sends a shipping confirmation or dispatches the goods to the customer.
  5. The Organizer assumes no procurement risk. If a product is not available, the customer will be informed without delay. Any payments already made will be refunded in this case.
  6. Orders can only be placed via the order form of the respective online shop.

§ 9.3 Prices, Payment and Shipping Costs

  1. All prices include the applicable statutory value added tax, where such tax applies.
  2. Any additional shipping costs, customs duties, import charges or other costs will be indicated during the ordering process, to the extent known to the Organizer.
  3. The available payment methods are displayed in the online shop.
  4. The purchase price is due upon conclusion of the contract, unless otherwise stated in the ordering process.
  5. For deliveries to countries outside the European Union, additional customs duties, taxes or fees may apply, which are to be borne by the customer and are not payable to the Organizer.

§ 9.4 Delivery

  1. Delivery is made to the delivery address provided by the customer.
  2. Delivery times are stated in the online shop or in the order confirmation.
  3. Delays due to force majeure, strikes, official measures, customs clearance, transport disruptions or other circumstances not attributable to the Organizer may extend the delivery time.
  4. Partial deliveries are permissible to the extent reasonable for the customer.

§ 9.5 Right of Withdrawal for Consumers

  1. Consumers have the right to withdraw from the contract within fourteen days without giving any reason.
  2. The withdrawal period is fourteen days from the day
    1. on which the consumer or a third party named by the consumer, who is not the carrier, takes possession of the goods,
    2. in the case of multiple goods ordered as part of a single order and delivered separately, on which the consumer or a third party named by the consumer, who is not the carrier, takes possession of the last item,
    3. in the case of delivery of goods in multiple partial shipments or pieces, on which the consumer or a third party named by the consumer, who is not the carrier, takes possession of the last partial shipment or the last piece.
  3. To exercise the right of withdrawal, the consumer must inform the Organizer of their decision to withdraw from the contract by means of a clear declaration. The declaration can be made, for example, by letter or email.

  5. The consumer may use the attached model withdrawal form for this purpose, but is not obliged to do so.
  6. To the extent legally required and technically provided, the withdrawal may additionally be declared via an online withdrawal function provided in the online shop.
  7. To meet the withdrawal deadline, it is sufficient for the consumer to send the notification of the exercise of the right of withdrawal before the withdrawal period expires.

§ 9.6 Consequences of Withdrawal

  1. If the consumer withdraws from the contract, the Organizer shall refund all payments received from the consumer, including delivery costs, with the exception of additional costs resulting from the consumer having chosen a type of delivery other than the cheapest standard delivery offered by the Organizer.
  2. The refund will be made without delay and no later than fourteen days from the day on which the notification of withdrawal was received by the Organizer.
  3. The same means of payment used by the consumer in the original transaction will be used for the refund, unless expressly agreed otherwise. The consumer will not incur any fees as a result of the refund.
  4. The Organizer may refuse the refund until it has received the goods back or until the consumer has provided proof of having returned the goods, whichever is earlier.
  5. The consumer must return or hand over the goods without delay and in any event no later than fourteen days from the day on which the consumer informed the Organizer of the withdrawal, to the return address specified by the Organizer.
  6. The deadline is met if the consumer dispatches the goods before the expiry of the fourteen-day period.
  7. The consumer bears the direct costs of returning the goods, unless otherwise stated in the online shop or in the withdrawal instructions.
  8. The consumer is only liable for any diminished value of the goods if this loss of value is attributable to handling of the goods that is not necessary for examining their condition, characteristics and functioning.

§ 9.7 Exclusion or Expiry of the Right of Withdrawal

  1. The right of withdrawal does not exist or may be excluded for goods that are made to customer specifications or are clearly tailored to personal needs.
  2. The right of withdrawal may also be excluded for sealed goods that are not suitable for return for reasons of health protection or hygiene, if the seal has been removed after delivery.
  3. Further statutory exceptions remain unaffected.

§ 9.8 Model Withdrawal Form

If you wish to withdraw from the contract, you may complete and return this form. Use of this form is not mandatory.

§ 9.9 Retention of Title

  1. The goods remain the property of the Organizer until full payment has been made.

§ 9.10 Warranty

  1. The statutory warranty rights apply.
  2. For used goods, to the extent such goods are sold in the shop, the statutory provisions also apply, unless a valid and legally permissible deviating agreement has been made in the individual case.
  3. Customary or technically unavoidable deviations in color, material, fit, print, wash or workmanship do not constitute a defect, provided they are reasonable and do not materially impair the agreed quality.

§ 9.11 Liability for Shop Purchases

  1. The Organizer is liable without limitation for damages in cases of intent and gross negligence.
  2. In cases of slight negligence, the Organizer is only liable for the breach of material contractual obligations and limited to the foreseeable damage typical for the contract.
  3. Liability for damages arising from injury to life, body or health, as well as mandatory statutory liability, remains unaffected.

§ 9.12 Vouchers, Discounts and Promotions

  1. Vouchers, discount codes and promotions are only valid under the conditions stated in each case.
  2. A cash payout of vouchers or discount values is excluded, to the extent legally permissible.
  3. If an order is cancelled, returned or reversed in whole or in part, the Organizer may recalculate the discounts granted and the resulting ticket allocations pursuant to § 4 accordingly.

§ 9.13 Contract Language and Storage of the Contract

  1. The contract language is German, unless another language is expressly indicated in the online shop.
  2. The contract text is stored by the Organizer. The customer receives the order data and these General Terms and Conditions by email or can view them in the customer account, where a customer account has been set up.

§ 9.14 Dispute Resolution

  1. The Organizer is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board, unless a legal obligation exists.

§ 10 Final Provisions

  1. Should individual provisions of these Terms of Participation be or become invalid in whole or in part, the validity of the remaining provisions shall remain unaffected.
  2. The statutory provisions shall apply in place of the invalid provision.
  3. Amendments or additions to these Terms of Participation require text form, to the extent legally permissible.
  4. Mandatory statutory rights of consumers remain unaffected.
